You Can Learn From My Mistakes

After being involved in a serious car accident, I really believed that my insurance company would take care of everything. It wasn't until I finally received their settlement offer that I realized they were not on my side at all. This is when I got wise and consulted a personal injury lawyer. It was the best decision I could have made. Thanks to my attorney, not only did I learn a lot about personal injury law, but I actually got the compensation that I needed and deserved. I made a lot of mistakes after my accident, but I also learned a lot along the way. It is my hope that this blog will allow other accident victims to learn from common mistakes and get the information they need to be successful in their own personal injury claims.

Pending Worker's Compensation Case? What Not To Do

by Riley Sanchez

If you have a pending worker's compensation case, you are likely trying to make sure you do all of the right things.  You've hired an excellent attorney, filled out and filed the documents in a timely manner and have been highly consistent with your testimony concerning what happened.  However, while all of these things are certainly beneficial, you may want to spend some time focusing on what not to do if you want to win.  Use this information to learn more about what to avoid if you want to have a successful outcome in your worker's compensation case.

Don't Let Your Behavior Contradict Your Testimony

One thing you definitely want to avoid doing is exhibiting behavior that is in violation to the claims that you have made.  This is counterproductive and could be misconstrued by the courts.

For example, you may have filed for worker's compensation because the extreme stress from your job has left you with horrible anxieties that make it difficult for you to leave home or be among large crowds.  However, after taking a medical anxiety prescription, you find that you feel much better and are ready to resume your previous lifestyle, even though your worker's compensation case is still open.

While you may indeed be feeling better, it's still important to avoid doing anything that may contradict your initial testimony.  Many insurance companies hire private investigators (PI's) to monitor individuals who have worker's compensation claims, so even when it may appear to you that no one is paying attention, there could be a hired PI taking snapshots of you going about your daily duties in a seemingly carefree way.

Don't Miss Those Doctor's Appointments

When you have a worker's compensation case, you should make every effort to attend each one of your scheduled doctor's appointments.  This matter cannot be stressed enough, because the medical records that are compiled by your doctor serve as powerful evidence that you were indeed injured on the job.

If you begin to miss your visits with the doctor, you won't have the solid medical proof that you need to substantiate your claim.  If an emergency comes up that you absolutely cannot avoid, quickly reschedule the doctor's visit as soon as possible.

Knowing what things to avoid is the key to you getting the restitution that you deserve.  The next time you have a worker's compensation case, heed these tips so you can come out a winner.
